CONSUMER RIGHTS – WITHDRAWAL – CANCELLATION RETURN CONDITIONS

" Exchange and return fees apply for purchases you have made from Faya Boutique. You can fill out the return and exchange form in the cargo completely and deliver it to Yurtiçi Kargo with the code in the text. No transaction will be made for cargoes that do not contain the form. "
GENERAL
- If you place an order electronically through the website you are using, you are deemed to have accepted the preliminary information form and the distance sales contract presented to you.
- Buyers are subject to the provisions of the Consumer Protection Law No. 6502 and the Distance Contracts Regulation (Official Gazette: 27.11.2014/29188) and other laws in force regarding the sale and delivery of the product they purchase.
- Shipping costs, which are the cost of shipping the product, will be paid by the buyers.
- The purchased product must be delivered complete and in accordance with the specifications specified in the order, and with documents such as the warranty certificate and user manual, if any.
- If the sale of the purchased product becomes impossible, the seller must notify the buyer in writing within 3 days of learning about this situation. The total price must be returned to the Buyer within 14 days.
IF THE PRICE FOR THE PURCHASED PRODUCT IS NOT PAID
- If the Buyer does not pay the price of the purchased product or cancels it in the bank records, the Seller's obligation to deliver the product ends.
PURCHASES MADE WITH UNAUTHORIZED USE OF A CREDIT CARD
- If, after the product is delivered, it is determined that the credit card used by the Buyer for payment has been used unfairly by unauthorized persons and the price of the sold product is not paid to the Seller by the relevant bank or financial institution, the Buyer must return the contracted product to the SELLER within 3 days, with the shipping costs being borne by the SELLER.
IF THE PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORSE REASONS
- If force majeure reasons that cannot be foreseen by the Seller occur and the product cannot be delivered on time, the situation will be notified to the Buyer. The Buyer may request the cancellation of the order, replacement of the product with a similar one or postponement of delivery until the obstacle is eliminated. If the Buyer cancels the order; if the payment was made in cash, this fee will be paid to the Buyer in cash within 14 days from the cancellation. If the Buyer made the payment by credit card and cancels, the product fee will be returned to the bank within 14 days from the cancellation, but the bank is likely to transfer the amount to the Buyer's account within 2-3 weeks.
BUYER'S OBLIGATION TO CHECK THE PRODUCT
- The Buyer shall inspect the goods/services subject to the contract before receiving them; shall not accept damaged and defective goods/services such as crushed, broken, torn packaging, etc. from the cargo company. The goods/services received shall be deemed to be undamaged and intact. The BUYER shall protect the goods/services with care after delivery. If the right of withdrawal is to be exercised, the goods/services shall not be used. The invoice shall also be returned together with the product.
DURATION OF THE RIGHT OF WITHDRAWAL
- The right of withdrawal cannot be exercised in service contracts where the service has started to be provided with the consumer's approval before the expiration of the right of withdrawal period. The Buyer is notified of the right of withdrawal in Distance Contracts and Cancellation Conditions, and the Buyer places an order with knowledge of the withdrawal conditions.
- In order to exercise the right of withdrawal, it is required that the SELLER be notified within 3 (three) days by registered mail, fax, e-mail or the method notified by the SELLER in writing or by the relevant method and that the product has not been used within the framework of the "Products for Which the Right of Withdrawal Cannot Be Used" provisions set forth in this contract.
EXERCISE OF THE RIGHT OF WITHDRAWAL
The invoice of the product delivered to the 3rd party or the BUYER (If the invoice of the product to be returned is corporate, it must be sent with the return invoice issued by the institution. Returns of orders whose invoices are issued in the name of institutions cannot be completed unless a RETURN INVOICE is issued.
- Return form, The products to be returned must be delivered complete and undamaged with their box, packaging and standard accessories, if any. Otherwise, returns will not be accepted.
RETURN CONDITIONS
If the value of the goods decreases due to a reason caused by the BUYER's fault or if return becomes impossible, the BUYER is obliged to compensate the SELLER for the damages in proportion to the BUYER's fault. Returns must be made with the original box or packaging.
- Returns of products whose original packaging has been damaged, which have lost their resalability, or which cannot be purchased by another customer are not accepted.
- It must be folded and packaged in at least 2 packages and all accessories must be undamaged. OTHERWISE IT WILL NOT BE ACCEPTED.
- Returns and exchanges are not possible for used products, products with perfume, cosmetic residues, etc. or products that have been washed. OTHERWISE, THEY WILL NOT BE ACCEPTED.
- If the amount falls below the campaign limit set by the SELLER due to the exercise of the right of withdrawal, the discount amount used within the scope of the campaign will be cancelled.
PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED
- According to the Regulation, it is not possible to return underwear, swimsuits and bikini bottoms, make-up materials, disposable products, goods that are prepared at the request of the BUYER or clearly in line with their personal needs and are not suitable for return, products that are in danger of rapid deterioration or whose expiration date is likely to pass, products that are not suitable for return in terms of health and hygiene if the packaging is opened by the BUYER after being delivered to the BUYER, products that are mixed with other products after being delivered and cannot be separated by their nature, used or damaged products, goods related to periodical publications such as newspapers and magazines, other than those provided within the scope of the subscription agreement, services performed instantly in electronic environment or intangible goods delivered instantly to the consumer, and audio or video recordings, books, digital content, software programs, data recording and data storage devices, computer consumables if the packaging is opened by the BUYER. In addition, it is not possible to use the right of withdrawal regarding services whose performance has started with the consumer's approval before the expiration of the right of withdrawal period, according to the Regulation.
- In order for cosmetics and personal care products, underwear, swimsuits, bikinis, books, copyable software and programs, DVDs, VCDs, CDs and cassettes, and stationery consumables (toner, cartridge, ribbon, etc.) to be returned, their packaging must be unopened, untested, undamaged and unused.
- According to the distance contracts regulation below; products for which the right of withdrawal cannot be exercised,
- Contracts for goods prepared in line with the consumer's wishes or personal needs.
- Contracts for the delivery of goods that are perishable or subject to expiry.
- Contracts regarding the delivery of goods whose protective elements such as packaging, tape, seal, package have been opened after delivery and whose return is not suitable for health and hygiene reasons.
- Contracts concerning goods that are mixed with other products after delivery and cannot be separated due to their nature.
- Contracts regarding books, digital content and computer consumables presented in material form, if protective elements such as packaging, tape, seal, package are opened after delivery of the goods.
- Contracts that must be made on a specific date or period, regarding accommodation, transportation of goods, car rental, food and beverage supply and the evaluation of free time for entertainment or recreation purposes.
- Contracts for services performed instantly in an electronic environment or intangible goods delivered instantly to the consumer.
- Exchanged products cannot be returned.
- There are no returns or exchanges for products in the campaign products, discounted products, accessories, blouses and underwear categories.
DEFAULT EVENT AND ITS LEGAL CONSEQUENCES
- The BUYER accepts, declares and undertakes that in case of default in case of payment transactions made by credit card, the cardholder will pay interest within the framework of the credit card agreement between the bank and the bank and will be liable to the bank. In this case, the relevant bank may resort to legal means; may demand the expenses and attorney fees from the BUYER and in any case, in case the BUYER defaults due to his debt, the BUYER accepts that he will pay the loss and damage suffered by the SELLER due to the delayed payment of the debt.
PAYMENT AND DELIVERY
- You can benefit from online single payment options with your credit cards through our website. In your online payments, the amount will be deducted from your credit card at the end of your order.
Shipping costs for returns and exchanges belong to the buyer. Exchange fee is 120₺, return fee is 200₺.
You must deliver your return cargo to the courier company within 2 business days from the day you receive it. Otherwise, your return will not be accepted.
Do not send your returned product in the gelatin bag inside the cargo bag that came to you. (The product will be damaged when sent in a single package). Otherwise, your return or exchange will not be made. Please send the product to us in at least 2 bags. In this way, you will send the product to us undamaged.
- You can find the necessary conditions below so that we can serve you better and faster regarding product returns; if any of these are missing, the product return will not be accepted.
- Returns of used or damaged products are not accepted.
- If the products sent to our quality assurance department are delivered in accordance with the return conditions, the refund of the product amount will be processed on the day the product reaches us. The product package opening and control period for the product you sent is 1-2 business days.
- Returns must be made with the original box or packaging.
- Returns of products whose original packaging has been damaged, which have lost their resalability, and which cannot be purchased by another customer are not accepted. The products you have sent will be sent back to you with the buyer's payment as soon as an odor is detected.
- It should be folded and packaged in at least 2 packages and with all its accessories without any damage. Used or washed products cannot be returned or exchanged.
- We can exchange and return items except for evening dresses, undergarments, accessories and discounted items. Our exchange and return period is 1-3 business days after receipt. We do not exchange or return items on discounted items.
- The shipping fee for returns belongs to the buyer. You must package the products you want to return in accordance with the conditions specified in the previous articles and deliver them to the cargo company (Yurtiçi Kargo) with a code and cash on delivery. You must send your return and exchange cargo with your order name and surname. Otherwise, we cannot reach you regarding your cargo.
- Shipments without a return and exchange form will not be accepted.
- You must send the products you want to return to the address.
